Please read these Terms carefully. By accessing, browsing, or using HPT Practice NSW in any way — including viewing pages, completing practice scenarios, submitting the contact form, or purchasing a paid tier — you agree to be bound by these Terms of Service and our Privacy Policy . If you do not agree, you must stop using the Website.

1. Acceptance of Terms

By accessing, browsing, or using HPT Practice NSW (hptpracticensw.com) in any way — whether or not you create an account, complete a purchase, or click an "I agree" button — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. Your continued use of the Website after any update to these Terms constitutes your acceptance of the updated Terms. If you do not agree to any part of these Terms, you must immediately stop using the Website.

These Terms are entered into between you and HPT Practice NSW, operated as a sole trader (ABN 14 380 906 076) ("we," "our," or "us"). References to "HPT Practice NSW" or "the Website" mean the website operated at hptpracticensw.com.

2. Description of Service

HPT Practice NSW provides educational resources to help learner drivers in New South Wales prepare for the Hazard Perception Test (HPT). Our services include:

  • A free starter tier with sample practice scenarios
  • A paid full-access tier with the complete library of scenarios
  • Email-based account access (magic-link sign-in) so your paid access travels with your email and works across devices
  • Educational blog articles and study guides
  • Tips and strategies for passing the HPT

3. Important Disclaimers

3.1 No Government Affiliation

HPT Practice NSW is NOT affiliated with, endorsed by, or connected to Transport for NSW, Service NSW, Roads and Maritime Services (RMS), or any government agency. We are an independent educational platform. Our practice materials are for educational purposes only and are not official test materials.

3.2 Practice Materials Disclaimer

Our practice scenarios are designed to simulate the types of hazard perception situations you may encounter on the official HPT. However:

  • Practice materials are educational simulations and may not exactly match the official test
  • The official HPT is administered solely by Service NSW and Transport for NSW
  • Success on our practice tests does not guarantee passing the official HPT
  • Official test requirements and formats are subject to change by government authorities

3.3 General Disclaimer

Subject to section 9 (Australian Consumer Law) below, the Website and all content are provided "as is" and "as available." We do not warrant that the Website will be uninterrupted, error-free, or that all content will be completely accurate or up-to-date.

4. User Responsibilities

4.1 Appropriate Use

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Website in any way that violates any applicable laws or regulations
  • Reproduce, distribute, or create derivative works from our content without permission
  • Attempt to gain unauthorised access to any portion of the Website
  • Use automated systems, scrapers, or software to extract data from the Website
  • Interfere with or disrupt the integrity or performance of the Website
  • Impersonate any person or entity or misrepresent your affiliation
  • Submit false, misleading, or fraudulent payment or contact information

4.2 Age Requirements

The free portions of the Website are intended for learner drivers aged 16 and above.

To purchase the paid tier you must be at least 18 years old, or have a parent or legal guardian make the purchase on your behalf. By completing a purchase you confirm that you meet this requirement. If you are under 18 and have purchased without parental authorisation, contact us and we will refund the transaction.

5. Intellectual Property and User Submissions

5.1 Our Content

All content on this Website, including text, graphics, logos, images, videos, scenarios, and software, is the property of HPT Practice NSW or its content suppliers and is protected by Australian and international copyright laws.

5.2 Limited Licence to You

We grant you a limited, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial use only. This licence does not include the right to download (other than page caching), republish, resell, or modify any portion of the Website without our express written consent.

5.3 Your Communications and Promotional Use

By sending us any communication — including messages through the contact form, emails, success stories, testimonials, feedback, suggestions, bug reports, or social media messages directed at us — you grant HPT Practice NSW a perpetual, worldwide, royalty-free, non-exclusive, sub-licensable licence to use, reproduce, adapt, publish, translate, and display the content of that communication for promotional, marketing, and educational purposes, in any media now known or later developed.

This may include using your message in marketing emails, on the Website, on social media, in blog posts, in advertising, or in other promotional material. We may attribute the message to a first name and a general location only (for example, "Sam, Sydney").

We will not publish your full name, email address, phone number, or other directly identifying contact details without your separate written consent.

If you do not want a particular message used promotionally, write "not for promotional use" at the top of your message and we will treat that message as private.

You confirm that any content you submit is your own and does not infringe anyone else's rights, and that you have authority to grant the licence above.

5.4 Marketing Emails to Purchasers

If you have purchased from us, we may occasionally email you about HPT-related updates, new practice content, or discounts on similar HPT-related products we offer ourselves. Every such email will contain a clear unsubscribe link, and unsubscribing will not affect your paid access to the scenarios you have already purchased. We do not share your email address with third parties for their marketing.

6. Payments

Payments for the paid tier are processed by Stripe Payments Australia Pty Ltd ("Stripe") as our payment processor. By making a purchase you also agree to Stripe's terms and privacy policy. We do not see, store, or have access to your full card number, CVC, or expiry date — Stripe handles those directly.

Prices are shown on the Website in Australian dollars (AUD) and include GST where applicable. The paid tier is sold as a one-off purchase that grants access to the full library of practice scenarios — there is no recurring subscription unless explicitly stated at checkout.

When you make a purchase, the email you use at Stripe checkout is recorded against your purchase in our database. Access to the paid scenarios is granted to that email — you can sign in on any device by requesting a magic link to that address. As a convenience, the device used at checkout may also retain a local purchase-state that grants access on that device only without needing to sign in. If you lose access (cleared cookies, switched browsers, lost device), request a fresh magic link from the sign-in page or contact us (see section 13).

7. Refunds

In addition to any rights you have under the Australian Consumer Law (see section 9), we voluntarily offer the following:

  • Duplicate charges — refunded in full, no questions asked. Our checkout deduplicates by email, but if a second charge ever slips through (for example, paying from a different email or card), contact us and we will refund the second charge.
  • Failure to deliver access — if you paid and cannot reach the paid scenarios after we have tried to help, you're entitled to a full refund.
  • Change of mind — at our discretion, generally available within 7 days of purchase if you have not made substantial use of the paid scenarios.

To request a refund, contact us at the address in section 13. Please include the email used at Stripe checkout, the approximate date of the charge, and the last four digits of the card.

7A. Account Access and Security

7A.1 Your Responsibility

Anyone who can read email at the address tied to your purchase can request a magic link and gain access to your paid scenarios. You are responsible for keeping that email account secure.

7A.2 New-Device Alerts

When we detect a sign-in from a device or network we have not seen on your account before, we send a security alert email to your address. If you do not recognise the sign-in, sign out of that device from the device management page and contact us immediately.

7A.3 Suspension

We may revoke individual sessions or your account access if we reasonably suspect abuse, account sharing, or breach of section 4.1.

8. Third-Party Links

The Website may link to third-party sites (such as Service NSW). We are not responsible for their content or privacy practices, and our links do not imply endorsement.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

10. Limitation of Liability

Subject to section 9, and to the fullest extent permitted by law, HPT Practice NSW shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, resulting from:

  • Your use or inability to use the Website
  • Any conduct or content of any third party on or related to the Website
  • Unauthorised access to or alteration of your data
  • Failure to pass the official HPT after using our practice materials

Where our liability cannot be excluded but can be limited, our total liability to you for any claim arising out of or in connection with these Terms or your use of the Website is limited, at our option, to (a) re-supplying the service or (b) refunding the amount you paid us in the 12 months preceding the claim.

11. Termination and Suspension

We may suspend or terminate your access to the Website (including paid access), without notice and without liability, if we reasonably believe you have breached these Terms, including section 4.1.

If we terminate your paid access for a breach of these Terms, you are not entitled to a refund. If we terminate your paid access for any other reason, you may request a pro-rata refund.

12. Changes

We may revise these Terms at any time by updating this page and the "Last updated" date above. Material changes will be flagged at the top of this page for at least 30 days. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.

14. General

14.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and HPT Practice NSW about your use of the Website and supersede any prior agreements on that subject.

14.4 Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including outages of third-party providers (Stripe, Resend, Cloudflare), internet failures, natural disasters, or government action.
